1. Introduction

The Copernicus Regional Center for Latin America and the Caribbean (CopernicusLAC Chile) is a project dedicated to the storage, processing, and distribution of Copernicus satellite data, the Earth Observation component of the European Union Space Program, in the Latin America and the Caribbean region.

CopernicusLAC Chile is implemented by the Center for Mathematical Modeling (CMM) of the Faculty of Physical and Mathematical Sciences of the University of Chile, funded by the European Commission through the Directorate General of International Associations (DG INTPA) together with the University of Chile, within the framework of the European Union – Latin America and the Caribbean Digital Alliance.

2. Data provision

In this scenario and in the fulfillment of its mission, CopernicusLAC Chile provides storage, processing and distribution services for satellite data in the areas of land use and coverage, monitoring and urban atlas; and monitoring of ocean coasts. The web portal allows you to view, search, process and download Earth observation data.

3. Copyright

Access to and use of Copernicus Sentinel data is available freely, completely and openly and is governed by the license CC BY-SA 4.0 (Creative Commons), in addition to the legal notice on the use of data and the Copernicus Sentinel service published here: https://sentinels.copernicus.eu/documents/247904/690755/Sentinel_Data_Legal_Notice.

4. User registration

To access Earth observation data on the CopernicusLAC Chile web portal, individuals and entities must register as users and provide the requested information. Upon registration, the user will be granted a password to access Earth observation data.

5. Privacy of personal data

When the user accesses the CopernicusLAC Chile web portal, they register as a user or download content, certain information about users, such as Internet Protocol (IP) addresses, downloaded data, pages visited, software used and time spent, as well as other similar information will be stored on the servers of CopernicusLAC Chile, with headquarters at Beauchef 851, Edificio Norte, floor -2, Santiago de Chile.

The information collected will be used in accordance with the Copernicus EU privacy policy. Whenever user information is shared with persons or entities other than the parties mentioned in the privacy policy, the data will be treated anonymously. 6. Use of cookies

Cookies are pieces of information that a web portal transfers to an individual hard drive for record-keeping purposes; Passwords are not saved in cookies. Cookies help us know which pages are visited most frequently and help ensure that the web portal responds to user needs.

7. Service availability

CopernicusLAC Chile will make every effort to provide data access services. All persons and entities that have accepted these Terms and Conditions understand and acknowledge that CopernicusLAC Chile is not in a position to guarantee the availability of Earth observation data all the time.

In particular, CopernicusLAC Chile reserves the right to review, modify, suspend or terminate the provision of Earth observation data at any time in the event of:

  • Technical capacity limitations due to the number of user requests.
  • Lack of sufficient funding to maintain Sentinel missions and associated facilities and activities.
  • Satellite or ground system failure.
  • Suspension or cancellation of the planned activities of the related systems and facilities of CopernicusLAC Chile, Copernicus EU and the Sentinel satellites.

The entities that operate Earth observation data provided through the Copernicus space data ecosystem may modify their satellite operations plans at any time, if they consider that such corrective action is necessary to ensure the safety and success of the missions.

8. Disclaimer

With respect to the service offered by CopernicusLAC Chile, the user will not have the right to claim against this entity, Copernicus EU, the Center for Mathematical Modeling, the University of Chile, its employees, related entities or employees of said entities, with respect to any injury or death of its own employees or employees of related entities or for damage or loss to its property or that of its related entities, whether such injury, death, damage or loss arises from negligence or otherwise, except in the case of serious negligence or malicious intent.

9. Use of CopernicusLAC Chile services

When registering on the CopernicusLAC Chile website, as well as when accessing, processing or downloading the available Earth observation data, the user will act in good faith and will not abuse or interfere with the service of the portals.

10. Other relevant matters

All matters not covered by this policy will be governed by the Copernicus EU Privacy Policy, available at https://dataspace.copernicus.eu/privacy-policy, in addition to Chilean regulations such as Law No. 19,628, of 1999, on the Protection of Private Life; article 19 No. 4 of the Political Constitution of the Republic; Law No. 20,285, on Access to Public Information; Law No. 20,575, which establishes the Principle of Purpose in the Processing of Personal Data; and the Recommendations of the Council for Transparency on the Protection of Personal Data by the Bodies of the State Administration, published in the Official Gazette on September 14, 2011.
